These Terms of Service ("Terms") govern your access to and use of the Homly website and services ("Homly", "we", "us", or "our"). By creating an account, browsing listings, or publishing properties, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Homly. You may not use the platform if you are under 18 years old or otherwise unable to enter into a binding contract.

1. About Homly

Homly is an online marketplace designed to connect owners, agents, and renters looking for long-stay homes. We provide tools to publish and discover property listings, but we do not act as a real estate broker, agent, or property manager.

Any agreements, payments, or rental contracts are directly between property owners or agents ("Hosts") and renters ("Guests"). Homly is not a party to those agreements and is not responsible for their performance.

2. Eligibility and accounts

• You must be at least 18 years old to create an account or publish listings.
• You are responsible for maintaining the confidentiality of your login details.
• You are responsible for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
• We may suspend or terminate your account if you violate these Terms or misuse the platform.

3. Listings and content

When you create a listing or upload content (such as photos, descriptions, or pricing), you are solely responsible for that content and confirm that:

• The information you provide is accurate, not misleading, and kept up to date.
• You have the right to offer the property for rent and to use any photos or media you upload.
• Your listing complies with applicable laws, zoning rules, building regulations, and community rules.

You agree not to post content that:

• Is fraudulent, deceptive, or intentionally misleading.
• Contains hate speech, harassment, threats, or incites violence or discrimination.
• Infringes any third party's intellectual property or privacy rights.
• Contains spam, unauthorized promotions, or malware.

We may, at our discretion, edit, hide, or remove listings or content that we believe violates these Terms or harms the platform, but we are not obligated to monitor all content.

4. Relationship between Hosts and Guests

Homly is not a party to rental agreements or negotiations. Any terms of stay, price, deposits, cancellation, or house rules are agreed directly between Host and Guest.

• Hosts are responsible for ensuring that their property is safe, as described, and compliant with local regulations.
• Guests are responsible for reviewing listings carefully, asking questions when needed, and complying with any agreed house rules and legal obligations.
• Homly does not verify the identity of Hosts or Guests, inspect properties, or guarantee the quality or suitability of listings.

5. Payments and deposits

At times, Homly may only act as a discovery and communication tool, and any payments, deposits, or contracts are handled outside the platform. Where we introduce built-in payment features, additional terms may apply.

You are solely responsible for understanding and complying with your tax, reporting, and financial obligations related to rentals or income generated from properties listed on Homly.

6. Acceptable use

You agree that you will not:

• Scrape, crawl, or use automated tools to extract data from Homly without consent.
• Attempt to gain unauthorized access to our systems, accounts, or data, or disrupt the platform's normal operation.
• Use the platform to send spam, phishing, or other unsolicited messages.
• Bypass security or technical restrictions we implement to protect the platform and users.

7. Intellectual property

Homly and its underlying technology, design, and branding are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on Homly, except as allowed by these Terms or applicable law.

By uploading content (such as photos, text, and other materials), you grant Homly a non‑exclusive, worldwide, royalty‑free license to host, display, and use that content solely for operating and promoting the platform. You can remove your content at any time, and this license will end for future use, except where we are required to retain backups or logs.

8. Disclaimers

Homly is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. For example, we do not guarantee that:

• Listings will be accurate, complete, or available at all times.
• Properties will meet your expectations or be suitable for your specific needs.
• The platform will be free from errors, interruptions, or security issues.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

9. Limitation of liability

To the maximum extent permitted by law, Homly and its founders, employees, and partners will not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, whether incurred directly or indirectly.
• Any loss of data, goodwill, or other intangible losses, resulting from your use of or inability to use the platform.
• Any interactions, disputes, or agreements between Hosts and Guests, including issues related to property condition, payments, deposits, or cancellations.

In any case, our total liability arising out of or in connection with these Terms will not exceed the amount you have paid to Homly (if any) in the twelve months before the claim arose.

10. Indemnification

You agree to indemnify and hold harmless Homly, its founders, and partners from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the platform.
• Your listings, content, or interactions with other users.
• Your violation of these Terms or any applicable law or regulation.

11. Termination

You may stop using Homly at any time and can request account deletion where available. We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these Terms, harmed other users, or created risk for us or the platform.

Even after termination, certain provisions of these Terms will remain in effect, such as those relating to intellectual property, disclaimers, limitations of liability, and indemnification.

12. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we may also provide additional notice, such as by email or a notice on the site.

By continuing to use Homly after changes become effective, you agree to be bound by the revised Terms.

13. Governing law

These Terms and any disputes arising out of or relating to them will be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. The specific jurisdiction and courts may depend on where Homly is legally established and operating.
